Terms of Service

By accessing or using the Gabriel Health Platform ("Gabriel," "the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and Gabriel. We may update these Terms from time to time; continued use after changes constitutes acceptance.

Gabriel is a technology platform that connects patients with integrative health practitioners, stores health data (including Bio-Well, HeartMath, and Nutrition Response Testing results), and provides AI-powered health insights and trend analysis.

Gabriel is a technology platform, not a healthcare provider. We do not diagnose, treat, or cure any medical condition. The Platform facilitates access to practitioners and health data; it does not replace licensed medical advice.

Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and current.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity. You may delete your account at any time through your account settings.

Practitioners using Gabriel must maintain all necessary licenses, certifications, and professional liability insurance. Practitioners are solely responsible for:

• The accuracy and quality of their clinical assessments and recommendations
• Compliance with HIPAA, state medical practice laws, and professional standards
• Maintaining appropriate malpractice insurance
• Clearly communicating the scope and limitations of their practice to patients

Gabriel does not employ practitioners and is not responsible for their actions or the outcomes of their care.

The Platform provides educational information and facilitates access to practitioners. It does not provide medical advice, diagnosis, or treatment.

• Always seek the advice of a licensed physician before making health decisions
• Do not disregard professional medical advice or delay seeking it based on information from Gabriel
• AI-generated insights are informational only and should not be treated as clinical recommendations
• Bio-Well, HeartMath, and NRT are complementary modalities; they are not substitutes for standard medical testing

In case of a medical emergency, call 911 or go to the nearest emergency room.

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Upload false, misleading, or inaccurate health information
• Impersonate another person or misrepresent your affiliation
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to our systems or other users' data
• Use automated tools (bots, scrapers) without our permission

All content, trademarks, logos, software, and materials on the Platform are owned by Gabriel or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your health data. By using the Platform, you grant Gabriel a limited, non-exclusive license to use your data to provide services, generate insights, and improve the Platform. We may use de-identified, aggregated data for research and development.

Certain features of the Platform may require payment. Fees are non-refundable unless otherwise stated. You authorize us to charge your payment method for all fees incurred.

Practitioners set their own fees for services. Gabriel may charge a platform fee or commission. All fees will be clearly disclosed before you confirm a transaction.

TO THE FULLEST EXTENT PERMITTED BY LAW, GABRIEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability exceed the amount you paid to Gabriel in the 12 months preceding the claim.

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless Gabriel, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Platform will cease immediately. You may request a copy of your health data within 30 days of termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Platform. Your continued use after such changes constitutes acceptance of the updated Terms.
